Land worth Rs 1.95 lakh crores encroached in Bangalore & Karnataka; including 867 Employees-Cum-Judges-Lokayuktas: 10.10.2014

It may be the biggest daylight land robbery in the state, but nothing much has been done to either book the encroachers or deter others. Around one-third of government land in Bangalore has been encroached upon – 41,303 acres worth Rs 1.03 lakh crore.
11 lakh acres encroached: Around 11.07 lakh acres or 10% of the total government land in the state has been encroached upon, according to official figures. However, V Balasubramanian, chairman of the task force for recovery and protection of government lands, calls it under-reporting. “By a conservative projection, the total encroachment of all government lands would be in the range of 12 to 15 lakh acres or 12%-15% of the total extent of government land,” he said in the report submitted in June 2011. A conservative estimate of the worth of the land is Rs 1.95 lakh crore.

Finally, there seems to be some hope for Bangalore as the protest led by freedom fighter HS Doreswamy and former legislator AT Ramaswamy seeking decisive action to recover the land is gaining momentum. Protesters feel the state government isn’t doing much to bring encroachers and land grabbers to book.

Bangalore Urban consists of five taluks -Bangalore North, Bangalore North Additional, Bangalore East, Bangalore South and Anekal. The total government land, including forests, is 1.3 lakh acres. Of this, 41,303 acres (31.77%) have been encroached upon. The Karnataka government told the high court that 33,878 acres had been encroached upon in the district. However, Ramaswamy, who headed the joint legislature committee of 17 members that unearthed encroachments in the city and surrounding areas in 2006-07, rejected this figure and said 41,303 acres have been encroached upon.

Ramaswamy says that even at a conservative estimate, 1 acre costs at least Rs 2.5 crore, which means the encroached land is worth Rs 1.03 lakh crore.”It’s the mother of all illegalities and a challenge to public authority. It’s a conspiracy against the society and the government. The present and past governments haven’t shown any political will to deal with the land mafia and recover the public land,” rues Ramaswamy.

Former additional chief secretary V Balasubramanian, who was also the chairman of the task force for recovery and protection of government lands, says the land could be worth much more. “Take, for instance, the encroached Byrasandra Lake. Many multi-storey business complexes have come up there. There, 1sqft of land costs about Rs 20,000,” he said. He puts the average price of land at Rs 2 crore to Rs 3 crore per acre in the district which means the total land encroached upon would be worth more than Rs 1 lakh crore.
Protesters are not satisfied with the government’s announcement of creating two deputy commissioner posts in Bangalore Urban district and the promise of constituting special courts after getting the President’s assent for the Karnataka Land Grabbing (Prohibition) Bill, 2011.

They also want the issue of encroachment by the poor treated differently from those by the mafia. The government has issued notices to encroachers, but not much has been done to deal with land grabbers.

Bangalore, Oct 18, 2014, DHNS. Bangalore district authorities launched a massive crackdown against land encroachers across all five taluks on Saturday and recovered more than 100 acres of government land in different parts of its jurisdiction valued at Rs 500 crore.

The biggest action was at Kannur in Bidarahalli Hobli of Bangalore East Taluk where 40 people had encroached upon 100 acres of pasture land (Gomala) in Survey Number 50, who were illegally operating a stone crushing factory. It is learnt that 50 acres of land was given to the Bangalore Metropolitan Transport Corporation (BMTC) and 20 acres to the Bruhat Bangalore Mahanagara Palike (BBMP).

This piece of land is considered to have high value for its proximity to the Kempegowda International Airport.

 The district authorities have identified Lokanath, Marim­uthu and Ganesh among others as the encroachers. Besides setting up a factory, they had constructed sheds for their employees. They had even developed a quarry to extract granite stone. The entire land was reclaimed in the presence of Deputy Commissioner of Bangalore Urban District V Shankar, Additional Commissioner R Venkatachalapathi, Assistant Commissioner Lakshmamma and Tahsildar Harish Naik.

Heavy police bandobast was made to ensure no law and order problem during the entire operation. The Superintendent of Police of Anti-Encroachment Task Force Zaafar Mirani was present.

In Bangalore North Additional Taluk, the district authorities took possession of the five acres and 24 guntas of government land in survey number 24 of Shivakote village under Hesaraghatta Hobli. At least nine people had encroached upon the land and had formed illegal layouts and were in a bid to sell sites.

They were cultivating some cash crops in some portion of the land. When Tahsildar Balappa Handigunda observed these illegalities, he served notices on them and evicted them on Friday.

The Bangalore North Taluk officials led by Tahsildar Shivappa Lamani evicted encroachment of half an acre of kharaab land in survey number 102 of Chikkabanavara village in Yashwanthapura Hobli. Some people had constructed houses on the government land and rented them out.

After serving notices on them, the encroachment was evicted.

The Bangalore South Taluk officials, led by Tahsildar Dr Dayanand busted a racket of illegal layout developers in Ramohalli and C Gollahalli.

A former Taluk Panchayath president Krishnappa had formed illegal layouts in these two villages and intended to sell sites for Rs 25 lakh each by creating forged documents, claimed a press note issued by the taluk officials. Criminal proceedings would be initiated against Krishnappa and others for their illegalities.

In Anekal Taluk, Tahsildar Anil Kumar recovered three acres and 20 guntas of lake land in survey number 124 of Mayasandra village of Attibele Hobli. The encroachers were operating a nursery on the encroached portion.

SC: Can’t tell accused who whistleblower is: 17.10.2014

NEW DELHI: In what is sure to encourage whistleblowers, the Supreme Court has ruled that identity of persons who tip off anti-corruption agencies about corrupt deals of bureaucrats can never be revealed to the accused facing prosecution under Prevention of Corruption Act.

Anti-Corruption Bureau of Maharashtra had investigated a case of disproportionate assets against a public servant on the basis of a complaint filed by “unknown person” and chargesheeted the accused. The accused wanted a copy of the original complaint on the ground that it was essential for a fair trial.

Rejecting his plea, an apex court bench of Justices K S Radhakrishnan and A K Sikri said it failed to see how the accused was prejudiced by non-disclosure of the name of the person who sent the complaint and the original copy of the complaint received by the ACB.

“Situations are many where certain persons do not want to disclose the identity as well as the information/complaint passed on by them to the ACB. If the names of the persons, as well as the copy of the complaint sent by them are disclosed, that may cause embarrassment to them and sometimes threat to their lives,” said Justice Radhakrishnan, who authored the judgment for the bench.

The bench said what is to be borne in mind is that it was a complaint given by some person to the ACB which triggered the investigation. “Thus, this complaint simply provided information to the ACB and is not the foundation of the case or even the FIR,” it said.

On the case in hand, the bench said, “In fact, (after receiving the complaint) the ACB held its own independent investigation into the matter and collected the material which was forwarded to the home department and on that basis, challan (chargesheet) was filed in the court pointing out that sufficient material emerged on record as a result of the said investigation to proceed against the petitioner under PC Act.”

The ACB had accused Manjeet Singh Khera of having huge movable and immovable property in Mumbai, Aurangabad and Nagpur. Khera had wanted a copy of the original complaint to be produced in the court as well as the name of the person who had sent that complaint.

The bench, while dismissing Khera’s petition, said, “We are of the opinion that non-supply of the complaint or contents thereof, do not, at all, violate the principle of fair trial. The said complaint has no relevancy in the context of this prosecution and in no manner, it would prejudice the petitioner.”

Sathasivam guide to journalism: No reason to ‘prevent’ media from court reporting (if journos always read judgments first): 17.10.2014

Kerala Governor and former Chief Justice of India P Sathasivam today told journalists to ensure that they report court cases after reading the judgments.

“First get the copy of the judgment… these days in the Supreme Court, it’s available on the internet after two or three hours. Then read the judgment and report. If such a thing takes place, I don’t find any reason to prevent the media from reporting court cases,” said Sathasivam, a former chief justice of India.

Delivering the convocation address at the Institute of Journalism here, he said journalism is a noble profession which not only informs the people but also enables and empowers them.

“A true journalist should be a reporter of the present and a pointer to the future. It was feared in the recent past that with the advent of electronic media and its astounding sweep, journalism would lose its impact and be relegated to the background.

“But the magic of the printed word and that of journalistic pursuit remained unaffected. In fact, both are complementary rather than contradictory, each aiding and abetting the other for mutual benefit,” he said.

Sathasivam urged journalists not to start and end as mere pen-pushers, transmitting news parrot-like to the reader.

“He has to analyse every bit of news, and report only those that will prove to be true. He should be honest to the core, but at the same time use his faculty of discretion to the full,” he added.

SC gives in on CBI whistleblower unmasking, allows Grover to file reports: 16.10.2014

The Supreme Court on Wednesday allowed the Special Public Prosecutor (SPP) in the 2G case, senior advocate Anand Grover, to file two reports on the role of CBI chief Ranjit Sinha in the probe and naming the person who leaked the contents of the visitor book at his residence.

A bench of Justice HL Dattu permitted Grover to file these reports with the court’s registry and without disclosing the identity of the whistleblower, withdrawing its earlier order, after Grover said that the report on the role of the Central Bureau of Investigation (CBI) director Sinha would be furnished in a sealed cover.

The court in its earlier hearing had asked Grover, who is heading the prosecution team in the special CBI court that is trying the 2G cases, to assist in ascertaining Sinha’s role in the case and whether the identity of the whistleblower could be made public.

The NGO Centre for Public Interest Litigation, which claimed it was in receipt of the visitor’s book at Sinha’s residence, had alleged that he had been meeting the accused in the 2G case and interfering to derail the probe and the trial.

The apex court on 22 September had asked Grover to examine all the material before the court including the entry register at Sinha’s residence and assist the court on the NGO’s application seeking a recall of its 15 September order asking to disclose the identity of the whistleblower.

The 15 September order had asked the CPIL disclose to it the identity of the whistleblower who gave information on alleged interference by Sinha in the probe and prosecution of 2G cases and also provided details of the accused who visited his official residence and met him.

The court had then said it “wants to know the authenticity of the person who has given the information”, and also ascertain the authenticity of the information provided.

Seeking the source of information, the court said that “information is of serious consequences” having the potential of damaging the “reputation of a person”.

Privacy trumps (alleged) abuse of state power: The Gujarat HC’s extraordinarily efficient judgment quashing the #Snoopgate inquiry: 15.10.2014

The Gujarat high court on Friday quashed a public commission formed to probe allegations of snooping on a woman, while ruling that the commission was not in the public interest, reported the Indian Express and others.

Setting aside the Gujarat government notification that had appointed the two-member Commission led by Justice Sugnya Bhatt to probe the snooping on a Bangalore-based female architect, allegedly at the behest of the then-Gujarat chief minister and now Indian prime minister Narendra Modi.

The court granted the plea of the alleged victim’s father, reported the Economic Times, who had approached the court praying to quash the commission since his daughter and his family were not “aggrieved” by the alleged surveillance.

In the ruling, Justice Paresh Upadhyay wrote:

“[…] in the commotion created by the shouts from various quarters, including the so-called custodians of the [alleged victim], the feeble voice of the [alleged victim] herself went into the background and it is the duty of this Court to listen to that very voice of the concerned citizen, how so feeble it may be, and on doing so, what is heard by this Court, in no uncertain terms is that, at least the concerned citizen states that, she does not want any inquiry in that regard and further that, what is alleged against the State Authorities had not resulted in intrusion in her privacy, but now what is sought to be done, certainly has resulted into intrusion in her privacy and has thereby resulted in violation of her fundamental right. It is this situation, against which the petitioners need to be protected by this Court.”

‘Landless poor being targeted, not land-grabbers’

Clear distinction should be made between the two, say activists

Even as a group of protesters launched an indefinite fast in Bangalore demanding action against encroachment of government land, farmers’ leaders have said that a clear distinction should be made between ‘land-grabbers’ and ‘landless poor’, who are doing bagair hukum (unauthorised) cultivation for survival.

Speakers at a consultation meeting on bagair hukum farmers here on Monday said officials were targeting only the landless poor in the name of evicting land-grabbers, while the real “land mafia” was getting away.

Eviction notices

Maruthi Manpade, president of the Karnataka Prantha Raitha Sangha (KPRS), said the State government had submitted an affidavit to the High Court stating that those occupying government and forestlands would be evicted.

“As many as 1.31 lakh people have received eviction notices, most of whom are poor bagair hukum cultivators,” he said. About 16 lakh farmers have applied for regularisation of their lands, he said.

G.N. Nagaraj, member of the State Secretariat of the Communist Party of India (Marxist), said members of the Anti-Land-grabbing Action Committee — including freedom fighter H.S. Doreswamy and A.T. Ramaswamy, who headed the Joint Legislature Committee set up to identify encroachment of government land — should declare that they oppose the poor being victimised.

Dalit Sangharsh Samiti (Ambedkar vada) State convener Mavalli Shankar said land grant committees, to whom applications have to be made for regularisation, were dysfunctional in most taluks. He accused the government of indulging in doublespeak by promising to protect poor farmers on the one hand and telling the High Court that they would be evicted on the other.

Mr. Manpade said the KPRS is launching a padayatra from Mysore to Bangalore (from October 7 to 13) and would hold a rally in Bangalore to demand amendments to the Karnataka Land Revenue Act, 1964, to ensure land to the landless.

The organisation is also planning to file a petition in the High Court over the same demand. “Individual farmers have already filed petitions,” he said.
